What Is Important to Understand About a Personal Injury Case?

Damages, Liability, and Compensation for Personal Injury Cases

Ohio personal injury law allows victims to recover both economic and non-economic damages from negligent parties.

Economic damages have no cap and include medical bills (past, present, and projected future), lost wages, reduced earning capacity, rehabilitation expenses, home modifications for disabling injuries, and property damage. That cap does not apply to catastrophic injuries. Permanent physical deformity, loss of a limb, loss of a bodily organ system, or an injury that prevents independent self-care qualifies as catastrophic, and the non-economic damages become uncapped.

Ohio’s comparative negligence rule, found in Ohio Revised Code § 2315.33, allows a defendant to argue that you share responsibility for your own injury. Your damages are reduced by whatever percentage of fault is assigned to you. If that percentage hits 51 or higher, you are barred from recovering anything.
