Ohio’s wrongful death laws establish specific rules about who can file, when, and what they can recover. Understanding these rules is essential before moving forward.

Filing eligibility. Under Ohio Revised Code § 2125.02, a wrongful death claim in Ohio must be filed by the personal representative of the deceased’s estate, typically the executor named in the will or appointed by the court. The claim is brought on behalf of the surviving beneficiaries, which generally includes the spouse, children, and parents of the deceased. Other family members may qualify depending on the circumstances.

Statute of limitations. Ohio gives surviving families two years from the date of death to file a wrongful death lawsuit under Ohio Revised Code § 2125.02. This deadline is firm. Missing it almost certainly means losing the right to pursue any compensation, regardless of how clear the liability is.

Comparative fault. Ohio’s modified comparative negligence standard under Ohio Revised Code § 2315.33 applies in wrongful death cases just as it does in standard injury claims. If the deceased is found to have contributed to the accident, the family’s recovery is reduced proportionally. Defense teams routinely attempt to assign fault to the deceased, and having an attorney who can challenge that strategy directly is critical.

Survival actions. Ohio law also permits a separate survival action under Ohio Revised Code § 2305.21, which allows the estate to recover for the pain, suffering, and medical expenses the deceased experienced between the time of the injury and the time of death. In cases where a victim survived for days, weeks, or longer before passing, these damages can be substantial and should be pursued alongside the wrongful death claim.

What Damages Are Recoverable in Toledo Wrongful Death Cases?

Ohio law allows surviving family members to recover a broad range of damages in a wrongful death claim. What is available depends on the specific circumstances of the case and the relationship between the beneficiaries and the deceased.

Economic damages include the financial support the deceased would have provided to the family over their expected lifetime, the value of services they performed at home, lost benefits including health insurance and retirement contributions, and funeral and burial expenses. In cases involving a primary wage earner, these losses can be enormous and require careful calculation with the help of economic experts.
