Ohio Legal Requirements for Serious Injury Cases
A few Ohio laws are particularly important to understand if you are pursuing a serious injury claim in Toledo.
Statute of limitations. Under Ohio Revised Code § 2305.10, most personal injury victims have two years from the date of injury to file a lawsuit in Ohio. In wrongful death cases, that same two-year window generally applies from the date of death. Missing this deadline means losing your right to compensation entirely, regardless of how strong the underlying claim is.
Comparative negligence. Ohio applies a modified comparative fault standard under Ohio Revised Code § 2315.33. If you share some responsibility for the accident, your compensation is reduced by your percentage of fault. If you are found to be more than 50% at fault, you are barred from recovering anything.
