Impaired and distracted truck drivers. Commercial drivers are held to a lower legal BAC threshold than passenger vehicle drivers under Ohio Revised Code § 4506.15. Distracted driving, including cell phone use behind the wheel, is equally dangerous at commercial vehicle scale. When either factor contributes to a crash, it significantly strengthens a victim’s claim.
Wrongful death from truck accidents. When a commercial vehicle collision kills someone, surviving family members may pursue a wrongful death claim against the liable parties. Ohio and Federal Legal Requirements for Truck Accident Cases
Truck accident claims operate under both Ohio state law and federal regulations, and understanding both matters to the outcome of your case.
Federal Motor Carrier Safety Regulations. Commercial trucking in Ohio is governed by FMCSA regulations that set standards for driver qualifications, hours of service, vehicle maintenance, and cargo securement. Violations of these rules are not just administrative infractions. They are evidence of negligence that can significantly strengthen a victim’s case and expose trucking companies to greater liability.
Statute of limitations. Under Ohio Revised Code § 2305.10, injured victims have two years from the date of the accident to file a personal injury lawsuit in Ohio. In wrongful death cases, the same two-year window applies from the date of death. Evidence in truck accident cases, including black box data and electronic logging records, can be overwritten or destroyed quickly. Waiting is not an option.
Comparative fault. Ohio’s modified comparative negligence standard under Ohio Revised Code § 2315.33 allows trucking companies and their insurers to argue that the victim contributed to the accident. If you are found more than 50% at fault, you recover nothing.
