Several Ohio laws directly shape how slip and fall claims are built and what victims can recover.

Duty of care. Ohio law distinguishes between different categories of visitors when determining what duty a property owner owes. Invitees, such as customers at a store, are owed the highest level of care. The property owner must actively look for hazards and either fix them or provide clear warning. Licensees, typically social guests, are owed a duty to warn of known dangers. The classification that applies to your situation affects how liability is established, which is one reason these cases benefit from early legal involvement.

Notice. To hold a property owner liable for a slip and fall in Ohio, you generally need to show they had actual or constructive notice of the hazardous condition. Actual notice means they knew about it directly. Constructive notice means the hazard existed long enough that they should have discovered it through reasonable inspection. Surveillance footage, maintenance records, and incident reports are often critical to establishing this, and they need to be requested before they disappear.

Statute of limitations. Under Ohio Revised Code § 2305.10, injured victims have two years from the date of the fall to file a personal injury lawsuit. That clock starts running the day you are hurt, not the day you finish treatment or realize how serious the injury is.

Comparative fault. Ohio’s modified comparative negligence rule under Ohio Revised Code § 2315.33 allows insurers to argue that you were partially responsible for your own fall. Wearing inappropriate footwear, being distracted, or ignoring a posted warning can all be used to reduce or eliminate your recovery. If you are found more than 50% at fault, you recover nothing. Having an attorney who can anticipate and counter these arguments is not optional in a contested slip and fall case.
