Ohio Legal Requirements for Premises Liability Cases
Ohio law governs how premises liability claims are evaluated, and a few key rules have a direct impact on whether and how much you can recover.
Visitor classification. The duty a property owner owes you depends on why you were on the property. Invitees, such as customers at a retail store, are owed the highest standard of care: the owner must inspect for hazards and either fix them or warn of their existence. Licensees, which typically includes social guests, are owed a duty to warn of known dangers. Trespassers are generally owed only a duty to avoid intentional harm, though children may be protected under Ohio’s attractive nuisance doctrine in certain circumstances.
Statute of limitations. Ohio Revised Code § 2305.10 gives injured victims two years from the date of injury to file a lawsuit. Miss that window and your claim is gone, regardless of how strong it is. Two years sounds like plenty of time. It is not, especially when evidence needs to be preserved early.
Comparative fault. Ohio uses a modified comparative negligence standard under Ohio Revised Code § 2315.33. If you are found partially at fault, your compensation is reduced proportionally. If you are more than 50% at fault, you recover nothing. Insurance companies know this rule well and routinely use it to argue that victims caused their own injuries. Having an attorney who can counter that argument is not optional, it is essential.
Notice. Most premises liability claims require proof that the property owner had actual or constructive notice of the dangerous condition. That means they either knew about it or should have known. Surveillance footage, maintenance logs, and prior incident reports are often the most valuable evidence, and they need to be requested before they are overwritten or destroyed.
What Damages Are Recoverable in Toledo Premises Liability Cases?
Ohio law allows injured victims to pursue several categories of compensation after a premises liability accident.
Economic damages are the calculable losses: medical bills, future treatment costs, physical therapy, lost wages, and reduced earning capacity if the injury affects your ability to work going forward.
